Welcome to Solar Guard Cameras. These Terms of Service ("Terms") govern your use of the Solar Guard Cameras website (the "Site") and the purchase of products and services from Solar Guard Cameras, a DBA of Comwire Services, LLC ("Solar Guard Cameras," "we," "us," or "our").

By accessing or using our Site, creating an account, or making a purchase, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or purchase our products.

1. Eligibility and Account Registration

Age Requirement

You must be at least 18 years old to use our Site or make purchases. By using our Site, you represent and warrant that you are at least 18 years of age.

Account Creation

To access certain features of our Site, you may need to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

2. Use of Services

Permitted Use

You may use our Site and services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Site or servers or networks connected to the Site
• Attempt to gain unauthorized access to any portion of the Site or any other systems or networks
• Use any robot, spider, or other automatic device to access the Site for any purpose
• Introduce any viruses, trojan horses, worms, or other material that is malicious or harmful
• Use the Site to advertise or offer to sell goods and services without our prior written consent

Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Solar Guard Cameras, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

3. Product Information and Pricing

Product Descriptions

We strive to provide accurate product descriptions and specifications. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free. If a product offered by Solar Guard Cameras is not as described, your sole remedy is to return it in unused condition in accordance with our return policy.

Pricing and Availability

All prices are displayed in U.S. dollars and are subject to change without notice. We reserve the right to modify or discontinue products at any time without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product.

Errors

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).

4. Orders and Payment

Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for any reason at any time after receipt. We may require additional verifications or information before accepting any order.

Payment

We accept payment through Square, Inc. and accept major credit cards, debit cards, and gift cards. By submitting payment information, you represent and warrant that:

• You have the legal right to use any payment card(s) or other payment method(s)
• The information you supply is true, correct, and complete
• You will pay all charges incurred by you at the prices in effect when such charges are incurred

Sales Tax

We will automatically calculate and add applicable sales tax to your order based on your shipping address and applicable state and local tax rates.

5. Shipping and Delivery

Shipping costs and estimated delivery times are calculated at checkout based on your location and selected shipping method. We are not responsible for delays caused by shipping carriers, weather, customs, or other factors beyond our control. Risk of loss and title for products purchased pass to you upon delivery to the carrier.

6. Returns and Refunds

We offer a 21-day return window from the date of confirmed delivery. To be eligible for a return:

• Product must be unused and in like-new condition
• All contents and packaging must be included
• No activation or account registration
• Refund issued after inspection
• Original shipping not refunded
• Customer pays return shipping unless Solar Guard is at fault

7. Product Warranties

Limited Warranty

Warranty is valid for one year from confirmed delivery. Covers defects in materials and normal wear.

What's Not Covered

• Physical damage or mishandling
• Weather exposure (unless rated)
• Power surges or lightning
• Tampering or unauthorized repairs
• Use with non-approved accessories
• Water damage caused by submersion, flooding, or use beyond the product's intended environmental rating

Warranty Claims

Contact support to initiate a claim. Return Authorization and prepaid label provided if needed. Customer must package items securely. If covered, we will repair or replace. If not, we may offer a discount replacement.

Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN OUR PRODUCT WARRANTIES, OUR SITE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

Service is provided "as-is" and "as-available." We are not responsible for missed alerts, lost recordings, or outages. Use an SD card for local backup. Liability is limited to the prior month's service fee.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOLAR GUARD CAMERAS, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You waive rights to punitive or indirect damages. Remedies are limited to direct damages. We do not guarantee real-time alerts or uninterrupted service. You are responsible for device setup and backups.

9. Indemnification

You agree to defend, indemnify, and hold harmless Solar Guard Cameras, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Cellular Data Plans and Billing

Available Plans

Solar Guard offers several monthly data plans tailored for camera usage:

• 2 GB
• 3 GB
• 5 GB
• 10 GB
• 25 GB

Billing and Payment

• All plans are billed monthly
• The billing period starts on the 19th of each month and ends on the 18th of the following month
• Your first month will be prorated based on your activation date
• Payment is due in advance of the billing period
• Service auto-renews unless canceled before the renewal date

Late Fees

A late fee of 20% of the outstanding balance (minimum $5.00) applies after 5 days of non-payment. Service remains suspended until full payment including fees is received.

Data Usage and SIM Cards

• Once the data limit is reached, the service will be paused until the start of the next billing cycle
• SIM cards remain the property of Solar Guard
• The SIM must remain in the assigned device
• Replacement fees apply for lost, damaged, or misused SIMs
• Service is intended for use within the United States only

11. Privacy

Your use of our Site and services is also governed by our Privacy Policy. Please review our Privacy Policy, which is incorporated into these Terms by reference.

12. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Disputes must be settled in Rusk County, TX.

Arbitration

Any dispute arising out of or relating to these Terms or the Site shall be finally settled by binding arbitration in Rusk County, Texas, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by updating the date at the top of these Terms and, at our discretion, providing additional notice such as adding a statement to our homepage or sending you an email notification. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

14. Termination

We may terminate or suspend your account and access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Site and supersede and replace any prior agreements.
